Liquid Robotics Genossenschaft · Effective: May 2026
§ 1 Scope
These General Terms and Conditions (“T&C”) apply to all contracts between Liquid Robotics Genossenschaft, Mühlestrasse 25, 9532 Rickenbach bei Wil (TG), Switzerland (hereinafter “Provider”) and customers who purchase products or place pre-orders through the website cocktailcrafter.ch.
Deviating or supplementary conditions of the customer shall not be recognised unless the Provider expressly agrees to them in writing.
§ 2 Contract Formation
The presentation of products on the website does not constitute a legally binding offer, but rather an invitation to order (invitatio ad offerendum).
A contract is formed when the customer places an order or pre-order and the Provider explicitly accepts it via order confirmation email.
The Provider reserves the right to decline orders without stating reasons.
§ 3 Products & Services
The Provider sells physical hardware products under the CocktailCrafter brand, in particular the CocktailCrafter — an automated cocktail dispensing machine. The exact scope of delivery is defined by the respective product description.
The VIP Kickstarter Slot allows customers to secure a unit at a preferential campaign price by paying a deposit. The remaining balance is due only after the campaign has successfully launched. If the campaign is cancelled, the deposit will be refunded in full.
Physical products are dispatched after receipt of full payment and within the stated delivery timeframe. Product specifications may change prior to final delivery; customers will be informed in advance by email.
§ 4 Prices & Payment
All prices are stated in Euro (EUR) unless otherwise indicated, and are exclusive of applicable taxes.
VAT Note: The Provider is a small business based in Switzerland. Pursuant to Art. 10 para. 2 lit. a of the Swiss VAT Act (MWSTG), the tax exemption applies for turnover below the statutory threshold. Invoices therefore do not include VAT. Customers from EU countries confirm with their order that they will comply with the tax regulations of their respective country.
- Payment is possible using the methods listed on the website.
- The deposit is due immediately upon ordering.
- The remaining balance for pre-orders is due after campaign launch.
- The Provider reserves the right to change prices for future orders. Confirmed orders retain the price valid at the time of ordering.
§ 5 Delivery
Delivery is by physical shipment only. Estimated delivery timeframes and shipping costs are provided on the Shipping page and in the order confirmation.
Pre-orders carry an estimated delivery window stated on the product page. This is an estimate and may shift due to production or development delays. Pre-order customers will be informed promptly by email of any changes.
The risk of accidental loss or deterioration of goods passes to the customer upon handover to the shipping carrier. The Provider ships with insurance.
§ 6 Right of Withdrawal
A statutory right of withdrawal of 14 days from receipt of goods applies to physical products. Details are set out in the Right of Withdrawal page.
The deposit may be withdrawn within 14 days of payment. No return shipment is required; withdrawal is effected by written notice. The deposit will be refunded in full.
Withdrawals must be submitted in writing to info@cocktailcrafter.ch.
§ 7 Warranty
The Provider warrants that delivered products are free from material defects at the time of handover and conform to the agreed specifications.
Defects must be reported in writing without delay. The Provider shall be entitled to first remedy defects by repair or replacement. If two repair attempts fail, the customer is entitled to a price reduction or cancellation of the contract.
Warranty claims expire after two years from delivery under Swiss law.
§ 8 Liability
The Provider is only liable for damages caused by intentional misconduct or gross negligence. Liability for slight negligence, loss of profit, indirect or consequential damages is excluded to the extent permitted by law.
The CocktailCrafter is designed for private household use. The Provider accepts no liability for damage resulting from improper use, failure to follow the operating instructions, or unauthorised modifications.
The Provider accepts no responsibility for the content of linked external websites. Use of external links is at the user’s own risk.
§ 9 Data Protection
The Provider processes personal data exclusively within the framework of applicable data protection law (Swiss revDSG and, where applicable, EU GDPR). Further information on data processing can be found in the Privacy Policy.
§ 10 Miscellaneous
- Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- The place of jurisdiction for all disputes is Rickenbach bei Wil, Canton of Thurgau, Switzerland, to the extent permitted by law.
- Should individual provisions of these T&C be invalid, the validity of the remaining provisions shall remain unaffected.
- The Provider reserves the right to amend these T&C at any time. The version in force at the time of contract formation shall apply.
Note for EU consumers: The choice of Swiss law does not deprive EU consumers of the protection afforded by the mandatory consumer protection provisions of their home country (Art. 6 Rome I Regulation). In particular, statutory warranty and withdrawal rights under EU law remain applicable.
